§ 10-78. Definitions.

  • Abandoned motor vehicle means a motor vehicle that is:

    (1)

    Inoperative and more than five (5) years old and left unattended on public property for more than forty-eight (48) hours; or

    (2)

    A motor vehicle, whether operable or not, that has remained illegally on public property for a period of more than forty-eight (48) hours; or

    (3)

    A motor vehicle, whether operable or not, that has remained on private property without the consent of the owner or person in control of the property for more than forty-eight (48) hours; or

    (4)

    A motor vehicle left unattended on the right-of-way of a designated city, county, state or federal highway within the city for more than forty-eight (48) hours.

    Antique auto means a passenger car or truck that is at least twenty-five (25) years old.

    Collector means the owner of one (1) or more antique or special interest vehicles who collects, purchases, acquires, trades or disposes of special interest or antique vehicles or parts of them for personal use in order to restore, preserve and maintain an antique or special interest vehicle for historic interest.

    Demolisher means a person whose business is to convert a motor vehicle into processed scrap or metal or to otherwise wreck or dismantle a motor vehicle.

    Garagekeeper means an owner or operator of a parking place or establishment, motor vehicle storage facility or establishment for the servicing, repair or maintenance of a motor vehicle.

    High grass and weeds means any high grass or weeds which attain such large growth as to become, when dry, a fire menace to adjacent improved property; weeds which are otherwise noxious or dangerous; poison oak and poison ivy when the conditions are such as to constitute a menace to the public health; dry grass, stubble, brush, or other flammable material which endangers the public safety by creating a fire hazard; grass, weeds, stubble, brush, that contributes to urban blight.

    Inoperative vehicle means any motor vehicle, motor home, boat, or trailer which cannot be operated or towed lawfully on a Texas public street or highway, due to removal of, damage to, or inoperative condition of any component part or the lack of an engine, transmission, wheels, tires, doors, windshield or any other part necessary for such movement or lawful operation, or in the case of motor vehicles, cannot be moved under its own power.

    Junked vehicle means a motor vehicle defined in V.T.C.A., Transportation Code § 683.071 et seq., or successor sections, that is inoperative, and:

    (1)

    A motor vehicle that displays an expired license plate or does not display a license plate;

    (2)

    Wrecked, dismantled, partially dismantled or discarded; or

    (3)

    Remains inoperable for a continuous period of more than thirty (30) days.

    Motor vehicle means a motor driven or propelled vehicle subject to registration under V.T.C.A., Transportation Code 501.000 et seq., the Certificate of Title Act, a trailer or semi-trailer, other than manufactured housing, that has a gross vehicle weight that exceeds four thousand (4,000) pounds. Motor vehicle includes, a boat, outboard motor or vessel subject to registration under V.T.C.A Parks and Wildlife Code 31.001 et seq.

    Nuisance means any condition or occurrence potentially dangerous or detrimental to any member or members of the public including conditions which are unsafe, potentially unsafe, obstruct the free use or enjoyment of property. Whatever is dangerous to human life or health, whatever renders the ground, the water, the air or food, a hazard or injury to human life or health or that is or threatens to become such, or contributes to urban blight is hereby declared to be a nuisance. Any condition determined by the enforcement official and/or city council to be a nuisance.

    Nuisance tarp means material used for screening from view a vehicle, boat, trailer, or other items that is torn, defective or worn.

    Police department means the police department of the City of Hurst, Texas.

    Rubbish means waste matter, trash, refuse, debris, dirt, dry grass, dead trees, tin cans, paper, and waste material of every kind, or other unhealthy substance, object or condition which is or when dry may become, a fire hazard, or which is or may become a menace to health, safety or welfare, or which is offensive to the senses and contributes to urban blight.

    Special interest vehicle means a motor vehicle of any age that has not been altered or modified from original manufacturer's specifications and, because of its historic interest, is being preserved by hobbyists.

    Storage facility means a garage, parking lot or any type of facility or establishment for the servicing, repairing, storing or parking of motor vehicles.

    Trash/debris includes abandoned and broken equipment or machinery or parts thereof; building materials not currently being used for the construction of improvements on the site; appliances, household furnishings or equipment, tools, machines, garbage cans, packing boxes, and broken or discarded furniture and other forms of household effects that have been abandoned and allowed to accumulate on private or public property; and vehicles, not limited to unregistered, inoperative or dismantled vehicles or vehicle parts.
