§ 14-8. Maintenance of parking lots.

  • (a)

    A parking lot is defined as a parking area open to business invitees, tenants or to the public generally, with or without charge. This term shall include driving and maneuvering lanes off public streets.

    (b)

    No parking lot shall be allowed to become deteriorated to the degree that there are visible holes more than one (1) inch deep in the surface thereof.

    (c)

    No parking lot shall be maintained in the city which does not have all parking spaces required by the city's zoning ordinance clearly marked.

    (d)

    No parking lot shall be maintained in the city in a condition hazardous to the users thereof or to their vehicles.

    (e)

    All repairs to a parking lot shall be permanent repairs and shall be equivalent to the original paving in both depth and material.

    (f)

    Responsibility for compliance with this section shall be on the owner thereof and the manager of the premises on which such parking lot is located. Should the owner or manager fail to complete repairs or otherwise come into compliance within sixty (60) days after written notice mailed by the city to the owner's or manager's address listed on the city's tax roll, the certificate of occupancy of the parking lot and of those businesses whose required parking is provided by such parking lot shall be automatically revoke and the utility company serving such businesses shall be required to discontinue service thereto. Such certificate and service shall not be restored until the parking lot complies with this section.

    (g)

    Should the owner or manager require more than sixty (60) days to comply with this section due to conditions beyond his control, the city council may, if the matter is brought to its attention and proof of such need presented within the original sixty (60) days, grant an extension of up to sixty (60) days.

    (h)

    Violations of subsections (b), (c) and (d) are Class C misdemeanors and any person owning or managing any such premises may be found guilty of violation of such sections with or without notice of such conditions.
