§ 21-7. Final plat.

  • (a)

    The final plat shall conform to the preliminary plat as approved, incorporating all changes, directions and additions imposed by either the planning commission or city council. The final plat shall not be released for filing until detailed engineering plans have been approved by the city and addresses assigned to each lot or parcel of land. All plats, preliminary and final, shall be deemed disapproved until there has been full compliance with all requirements contained in this chapter and such additional requirements imposed by the city or its agents for which provision is herein made.

    (b)

    Prior to submission of the final plat to the planning and zoning commission, the final plat and all required plans shall be submitted to the director of public works for checking compliance with city design standards and the preliminary plat.

    (c)

    Five (5) sets of engineering plans showing details of streets, alleys, culverts, bridges, storm sewers, water mains, sanitary sewers and other engineering details of the proposed subdivision shall be submitted to the director of public works along with the final plat of the subdivision. Such plans shall be prepared in digital format, by a registered professional engineer licensed to practice in the State of Texas and shall conform to the standard specifications established by the city. Upon plan approval by the city, the plat and all proposed improvements separated on different layers shall be submitted in a format specified by the public works department prior to placement of the final plat on the city council agenda.

    (d)

    Following the completion of engineering plans, pro rata changes, impact fee credits shall be calculated as provided by article II of this chapter. The developer shall provide cost figures for all items for which a credit is requested, and such items shall be subject to verification.

    (e)

    Two (2) mylar and eight (8) prints or copies of this final plat, not larger than twenty-two (22) inches by thirty-four (34) inches, shall be submitted to the planning commission by filing the same in the office of the director of planning and development at least twenty-eight (28) days prior to the date of the regular meeting of that body at which consideration is requested and on which date such plat shall be deemed filed. This plat shall carry the legend Final Plat and shall be drawn to scale of one (1) inch equals one hundred (100) feet. All figures and letters shown thereon shall be plain, distinct and large enough to be easily read. Should more than one (1) sheet be required for the layout, there shall be included with the several large-scale drawings a key map showing the entire subdivision, drawn at a smaller scale, with block numbers and street names; this key map is to be included upon the first sheet or separately upon a cover sheet of the same size as the large-scale sheets. The final plat shall show or be accompanied by the following information:

    (1)

    The subdivision name or identifying title and the name of the city, county and state in which the subdivision is located as well as the name and address of the record owner or subdivider.

    (2)

    The name or names of adjacent subdivisions, names of streets and numbers of lots and blocks. Names of new streets should, whenever possible, follow or be extensions of existing street names.

    (3)

    An accurate boundary survey of the property which is being subdivided, noting the bearings and distances of the sides, the same being referenced to original survey lines, or established subdivisions showing the lines of all adjacent lands and property, lines of adjacent streets, alleys and easements, noting width and names of each. Streets, alleys and easements of adjacent subdivisions shall be shown in a different manner than those of the proposed subdivision, possibly dotted or dashed.

    (4)

    The location of all the lots, streets, highways, alleys, easements, parks, playgrounds and other features with accurate dimensions given in feet and decimals of a foot, showing the length of radii, deflection angle and arcs of all curves; tangent distances and tangent bearings shall be given for each street, all such data being complete and sufficiently precise to permit accurate location upon the ground.

    (5)

    Construction plans for all required improvements, such as:

    a.

    Proposed water distribution system;

    b.

    Proposed sewage collection system;

    c.

    Plan and profile of proposed streets and sidewalks;

    d.

    Plan and profile of onsite and offsite proposed drainage facilities, including storm sewers where required.

    (6)

    The building lines of front and side streets shall be shown dotted or dashed, and the location of utility easements shall be shown in dashed lines.

    (7)

    The plats shall bear a properly executed dedication of all streets, highways, alleys, parks, playgrounds and other lands in tended for use of the public, such dedicatory instruments to be signed by the owner or owners and by all other persons or parties having a mortgage or lien interest in the property. Any private restrictions or any trusteeships intended shall be filed with the plat if the same are too lengthy to permit lettering upon the plat.

    (8)

    A receipt indicating that all taxes have been paid.

    (9)

    Proper certification shall be made upon the plat by a reputable registered civil engineer or land surveyor, licensed in the state, ascertaining that the plan represents a survey made by him and that all necessary monuments are accurately and correctly shown upon the plat. The engineers shall place such monuments as required by the city, and they shall be set at all corners in angle points of the boundaries of the original tract to be subdivided and at all street intersections, angle points, street lines and points of curve and at such intermediate points as shall be required by the city. All lot corners shall also be marked with pipe markers driven firmly into solid earth. Such monuments shall be of pipe not less than three-fourths (¾) of an inch in diameter and two (2) feet in length driven securely into solid earth with the grades of the same being at the grade with the established sidewalk or, if a walk is not established, flush with natural grade of the earth's surface.

    (10)

    Proper blanks for certification of approval to be filled out by the planning and zoning commission and city council and blanks for cabinets, slide and date to be filled out by the county.

    (11)

    Date, scale and north point.

    (12)

    Site data, including total area of platted land, total area in each zoning classification, total number of lots in each zoning classification, lot density per acre, minimum and average lot area for residentially zoned lots.

    (13)

    Impact fee assessment and credit calculation, pro rata charges and a receipt indicating that such charges have been paid.

    (f)

    After approval, disapproval or the expiration of thirty (30) days from the date the final plat is filed with the planning and zoning commission, whichever occurs first, the final plat shall be deemed filed with the city council, and it shall approve or disapprove such final plat within thirty (30) days thereof. If the council should fail to so act, the plat shall be subject to certification and filing in the office of the county clerk.

    (g)

    After approval of the plat by the city council, a white background blue-line print and one (1) reproducible print shall be furnished to the public works department. All figures, letters and symbols shown upon the drawings shall be plain, distinct and of sufficient size that may be easily read and of such density that they will remain a permanent and lasting record.

    (h)

    After all improvements required of the city have been completed by the owner or subdivider of the proposed subdivision, the city council will require one (1) set of as-built drawings of all underground utilities and street improvements that have been constructed, the same to be filed within thirty (30) days after completion of all required improvements.

    (i)

    Approval of a final plat shall expire unless the original plat is submitted to the city for recording in the office of the county clerk within a period of six (6) months after the date of final approval.

    (j)

    Upon approval of the final plat, all necessary permits or certificates authorized thereby may be issued. Subsequent to such approval, minor changes may be authorized by the enforcing officer when such minor changes will not cause any of the following circumstances to occur:

    (1)

    A change in the character of the development;

    (2)

    An increase in the problems of access, shared access, circulation, safety and utilities;

    (3)

    A reduction in the originally approved setbacks from property lines;

    (4)

    A reduction in lot size.
