§ 26-57. Purpose and policy.

  • This division sets forth uniform requirements for users of the publicly owned treatment works for the City of Hurst and enables the city to comply with all applicable state and federal laws, including the Clean Water Act (33 United States Code 1251 et seq.) and the General Pretreatment Regulations (40 Code of Federal Regulations Part 403).

    (a)

    This division provides for prohibitions on discharges of certain substances into the public sewer system of the city from all sources: domestic, commercial or industrial. A further purpose of this division is to set forth uniform requirements for industrial dischargers into the POTW authority wastewater collection and treatment systems, and to enable the authority to protect the public health and POTW personnel in conformity with all applicable state and federal laws relating thereto. Parts of this division are enacted pursuant to regulations established by the U.S. Environmental Protection Agency (EPA) as set forth in 46 CFR 9404—9460. Many of the terms defined in this division correspond to the terminology employed in the EPA regulations.

    (b)

    All categorical pretreatment standards, lists of toxic pollutants, industrial categories and other standards and categories which have been or which will be promulgated by the EPA shall be incorporated as a part of this division, as will EPA regulations regarding sewage pretreatment established pursuant to the Clean Water Act, and amendment of this division to incorporate such changes shall not be necessary. The authority shall maintain current standards and regulations which shall be available for inspection and copying.

    (c)

    The objectives of this division are:

    (1)

    To prevent the introduction of pollutants into the authority wastewater system which will interfere with the normal operation of the system or contaminate the resulting sludge;

    (2)

    To prevent the introduction of pollutants into the authority wastewater system which do not receive adequate treatment in the POTW and which will pass through the system into receiving waters or the atmosphere or which are otherwise incompatible with the system; and

    (3)

    To improve the opportunity to recycle or reclaim the wastewater and to dispose of, recycle or reclaim the sludge generated by the POTW.

    (d)

    The regulation of discharges into the authority wastewater system under this division shall be accomplished through the issuance of permits, as specified in section 26-64, and by monitoring and inspection of facilities according to this division.

    (e)

    The director shall have the authority to promulgate such administrative regulations as are from time to time necessary for the enforcement of this division.

    (f)

    To provide for fees for the equitable distribution of the cost of operation, maintenance, and improvement of the POTW.

    (g)

    To enable the POTW to comply with its TPDES permit conditions, sludge and disposal requirements, and any other federal and state laws to which the POTW is subject.

    (h)

    Administration:

    (1)

    The public works director and the director's authorized representatives are authorized to administer, implement, and enforce the provisions of this division. Additionally, the director and the director's authorized representatives are authorized to make inspections pursuant to this division and to take enforcement action against violators.

    (2)

    For the purpose of promoting consistency of enforcement throughout the city's jurisdiction and service area, the director shall promulgate an enforcement response plan.

    (3)

    The director shall have the authority to promulgate administrative regulations which are consistent with this division and which are necessary for the proper administration and enforcement of this division.

    (4)

    Persons and facilities regulated under this division are subject to the authority of the U.S. EPA under Section 308 of the Federal Clean Water Act, and the TCEQ under V.T.C.A., Water Code §§ 26.014 and 26.015 and V.T.C.A., Health and Safety Code §§ 361.032 and 361.037 concerning access to information and right of entry upon property.
