§ 13-5. Jury.

  • (a)

    A person who is charged with an offense before the municipal court of record is entitled to a trial by jury unless that right is waived according to law. The jury shall decide all questions of fact and determine the credibility of witnesses. The court shall determine all matters of law and shall charge the jury on the law.

    (b)

    Jurors shall meet the qualifications set forth in Chapter 62 of the Texas Government Code. Jurors shall be at least eighteen (18) years of age, residents of the city, qualified to vote (but need not be registered to vote), able to read and write, of sound mind and moral character, not convicted of a felony, and not under indictment or legal accusation of misdemeanor or felony theft or any other felony, and shall not have served as a juror for six (6) days during the preceding three (3) months.
