§ 14-3. Obnoxious fumes, smells, etc., a nuisance.

  • (a)

    It shall be unlawful for any person using, maintaining or operating any buildings, structures, lands or premises within the city limits for the purpose of the refining, rerefining, distillation or reclamation of oil or oil products, petroleum or petroleum products, sulphur or sulphur products or for the purpose of tanning hides or processing dead animals, to cause or permit offensive or obnoxious vapors, fumes, smells, odors or stenches to be emitted from such buildings, structures, lands or premises. Such vapors, fumes, smells, odors or stenches shall be deemed to be offensive or obnoxious if it is offensive or obnoxious to a person of ordinary sensibilities.

    (b)

    All buildings, structures, lands or premises within the city limits being used, maintained or operated by anyone for any of the purposes set out in subsection (a) which are not provided or equipped with proper, effective and adequate safeguards, accessories and precautions to prevent the emitting of offensive or obnoxious vapors, fumes, smells, odors or stenches therefrom shall constitute a nuisance.
