§ 27-8. O-1 Office District.

  • (a)

    Purpose of district. The O-1 Office District is intended to permit areas of limited low-intensity office uses having similar land use controls to the R-1 district.

    (b)

    Permitted uses. The following are the only permitted uses within the O-1 Office District and are subject to the general conditions of this section and such other sections as are applicable:

    (1)

    Professional offices and any other office not requiring the display or inventory of merchandise;

    (2)

    Libraries, parks and playgrounds, churches, elementary and junior high schools, and educational institutions offering programs equivalent to public school grades;

    (3)

    Public buildings including fire stations, municipal buildings and city halls;

    (4)

    Water wells, water storage and pumping facilities.

    (c)

    Planned development uses. The following uses shall be allowed in O-1 planned development uses:

    Permitted uses under R-1 zoning.

    (d)

    Conditional uses. Lodges, fraternal organizations, civic clubs subject to conditional use requirements of R-1 and the additional requirement that there be no sale of alcoholic beverages to members or the public.

    (e)

    General conditions.

    (1)

    Area requirements:

    a.

    Minimum lot size. Every lot within the zoning district shall be at least ten thousand (10,000) square feet in area.

    b.

    Minimum lot width. Every lot within this zoning district shall be at least eighty (80) feet in width, measured at the front building line.

    c.

    Maximum coverage. No more than thirty (30) percent of the total lot area shall be covered by the buildings.

    (2)

    Outdoor activities or uses: No outdoor activities or uses shall be permitted in the O-1 district other than accessory parking and the servicing of refuse containers.

    (3)

    Yard requirements:

    a.

    Every lot within this district shall have exterior yards of at least twenty-five (25) feet.

    b.

    Every lot within this district shall have side and rear yards of at least ten (10) feet, subject to provisions of subsection 27-21(b)(4).

    (4)

    Height restrictions: No building shall exceed thirty-five (35) feet in height.

    (5)

    Fences and screening: Fences and screening as set forth in section 27-21 shall be provided and maintained.

    (6)

    Parking and loading:

    a.

    Generally. Parking and loading as required in Table 20-3 shall be provided. Except as otherwise provided by subsection (e)(6)(b) of this section, no vehicle shall be parked and no object shall be stored in any required exterior yard or between a residential, abutting street, primary or secondary collector and the principal structure on a lot.

    b.

    Corner lots on arterial. On corner lots abutting a street classified by the city's thoroughfare plan as a minor arterial or principal arterial, parking and loading may be provided between the building and the arterial street subject to the requirements of section 27-20 of this chapter. No vehicle shall be parked and no object stored in any required exterior yard abutting a residential street, a primary collector or a secondary collector.

    Signs: Subject to the general restrictions of section 27-22.

    Building materials and appearance:

    a.

    All buildings shall have exterior walls of not less than seventy-five (75) percent masonry surface.

    b.

    The area of window and door openings along each exterior wall shall not exceed sixty (60) percent of the area of such exterior wall.

    c.

    Roof designs shall be of mansard, hip or gable type.

    d.

    As a special exception, the board of adjustment may permit modification of these standards for building materials on appearance when they find that such modifications may be compatible with existing development of all surrounding property based upon the following:

    1.

    Materials to be used are similar to those actually in use and to those permitted on undeveloped sites.

    2.

    Placement of doors and windows will not create adverse effects on adjoining properties by reason of interior lighting, pedestrian flow, reflection of sunlight or heat or noise.

    3.

    Materials to be used and their location of use will not create unusual problems of fire hazard, of buildings security or other conditions inconsistent with the uses allowed under the regulations of a fully conforming structure.

    (10)

    Refuse facilities: All refuse and refuse containers shall be screened from view of all adjacent public streets.

    (11)

    Hours of operation: No use within this district shall be open to the public except during the hours of 6:00 a.m. to 10:00 p.m., provided, however, this limitation shall not be applicable to fire stations or other essential municipal services.

    (12)

    Landscaped open area: In addition to paved parking and driving areas, at least twenty (20) percent of the lot shall be maintained in landscaped open area.

    (f)

    Planned development regulations:

    (1)

    O-1 PD uses shall be subject to O-1 general conditions; provided, however, that the following O-1 general conditions may be specifically modified by the site plan or ordinance adopting such site plan:

    a.

    Minimum lot size;

    b.

    Minimum lot width;

    c.

    Yard requirements;

    d.

    Maximum building height;

    e.

    Access;

    f.

    Building to lot ratio;

    g.

    Maximum lot coverage;

    h.

    Parking and loading;

    i.

    Sign regulations;

    j.

    Landscape regulations;

    k.

    Exterior wall surface;

    l.

    Screening requirements.
